Copyright & DMCA Policy

If someone posts your copyrighted work without permission, here’s how to get it taken down. If your post got pulled and you think that was a mistake, here’s how to push back. Standard DMCA process, laid out below.


Board Rats, operated by WP Hatch, Inc., respects intellectual property rights and expects its members to do the same. This policy explains how to report content you believe infringes your copyright, and how the person who posted it can respond. It follows the notice-and-takedown process of the US Digital Millennium Copyright Act (DMCA).

Reporting infringing content (takedown notice)

If you own a copyright (or are authorized to act for the owner) and believe content on Board Rats infringes it, send a written notice to our designated agent that includes:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim was infringed.
  3. Identification of the infringing material and enough information for us to locate it (e.g. the URL of the post).
  4. Your contact information (name, address, phone, email).
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner’s behalf.

On receiving a valid notice, we will remove or disable access to the material and make a reasonable effort to notify the member who posted it.

Counter-notice

If your content was removed and you believe it was a mistake or misidentification, you may send our agent a counter-notice that includes:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location where it appeared.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address, and phone number, and a statement consenting to the jurisdiction of the federal court for your district (or, if outside the US, the district where Board Rats is located), and that you’ll accept service of process from the party who filed the original notice.

If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant files a court action seeking to restrain the activity.

Repeat infringers

We track DMCA notices against accounts and will, in appropriate circumstances, suspend or terminate the accounts of members who are repeat infringers or who receive multiple valid notices.

Misuse

Filing a false or bad-faith notice or counter-notice may make you liable for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA.
